DIGITAL DELIVERY POLICY

This Digital Delivery Policy explains how all digital components included in our hybrid products (Digital + Physical) are delivered immediately and considered fully fulfilled at the time of purchase, even when the physical component is shipped later.

Manuals, guides and usage instructions

Product registration and exclusive digital content

Access to professional material, tutorials and downloadable files
These digital components have independent economic value and are considered part of the total product purchased.
3. Immediate Fulfillment of Digital Goods
All digital goods are delivered immediately after the customer completes the checkout.
Delivery occurs through one or more of the following methods:

Instant email confirmation with access links

Access through the “My Courses” or “My Products” section

Secure download links
-
Digital badge activation tied to the order

Automatic account creation for training platforms

Access credentials provided instantly after payment
Once payment is confirmed, digital delivery is considered completed, regardless of the status of the physical shipment.
4. Hybrid Products (Digital + Physical)
Many Make Beauty products are classified as Hybrid Digital + Physical Goods, meaning the order contains two types of deliverables:

DIGITAL COMPONENT
Delivered instantly
→ commercial fulfillment completed at purchase
→ non-refundable once accessed or delivered -
PHYSICAL COMPONENT
Shipped separately with standard or extended delivery times
The digital portion is an essential and independent part of the purchase, and therefore:

The contract of sale is partially fulfilled immediately

The customer receives a significant portion of the product at purchase

Disputes related to “item not received” apply only to the physical portion

Digital delivery cannot be reversed once issued

For every order containing digital items, Make Beauty records:

digital access logs

metadata confirming delivery

automatic Shopify metafields with digital delivery status

Stripe metadata confirming the digital portion was delivered
These records serve as legal proof of contract fulfillment, accepted by:

PayPal

Visa & Mastercard, and all anothers cards dispute departments

International consumer protection agencies

Courts and arbitration systems
6. Refund, Cancellation and Chargeback Conditions
Digital goods are non-refundable once delivered, in compliance with:

EU Directive 2011/83 – Digital Content Exceptions
Art. 49 CDC – exceptions for digital content delivered immediately
International Ecommerce Digital Supply Standards
If the customer has accessed, downloaded or received any digital component, the refund applies only to the physical portion, if eligible.
Chargeback Restrictions
Chargebacks claiming “item not received”, “service not provided”, or “product not delivered” do not apply to digital components because:

logs and access data prove fulfillment

the customer has already received valuable content

contractual obligations were partially fulfilled
Make Beauty provides proof of the digital delivery to financial institutions when necessary.
7. Physical Shipment Delays
If the physical component is delayed due to:

logistics issues

customs clearance
-
international freight delays
-
temporary stock shortages
-
transportation restrictions
the digital portion of the order remains fulfilled, and the order as a whole is still valid.
The customer may request:

Updated tracking
-
Status notifications
-
Estimated delivery windows
But not cancellation of the digital portion, which has already been delivered.
8. Customer Responsibilities
By completing the purchase, the customer agrees to:

Provide a valid and accessible email address

Check spam/junk folders for digital access

Ensure they can open and view digital content
-
Keep access credentials secure
Failure to access digital content due to customer-side issues does not invalidate digital delivery.
9. Proof of Delivery Provided Automatically
Upon purchase, the customer receives:

Order receipt including digital items

Timestamped access log

Unique digital certificate (when applicable)

Product authenticity badge
This serves as non-repudiable evidence that the digital product has been delivered.
